Feiten

De verdachte handelde in verdovende middelen. Het slachtoffer was één van zijn klanten en was hem nog geld schuldig. Op gegeven moment is de verdachte naar de woning van het slachtoffer gegaan. Het slachtoffer had bedacht dat de verdachte een lesje zou worden geleerd. Het slachtoffer heeft de verdachte binnengelaten en had een verzwaarde sok in zijn handen. Ze zijn in gevecht geraakt. De verdachte is met een fles geslagen en met een mes bedreigd. Op een gegeven moment legde het slachtoffer het mes op tafel en liep naar de bank in de woonkamer. De verdachte heeft het mes gepakt en is naar het slachtoffer gelopen. Deze draaide zich om en maakte een beweging alsof hij de verdachte wilde aanvallen. Hierop heeft de verdachte het slachtoffer zestien maal met het mes gestoken en/of gesneden. De verdachte doet een beroep op noodweerexces wegens een hevige gemoedsbeweging.

Rechtsvraag

Is er buiten de grenzen van noodzakelijke verdediging getreden?

Oordeel Hoge Raad

De Hoge Raad is van mening dat een beroep op noodweerexces niet slaagt, omdat er te ver buiten de grenzen van verdediging is getreden. Door deze disproportionaliteit is een beroep op noodweer(exces) niet meer mogelijk.
